Welcome to Tidewater Totes, ("Tidewater Totes," "we," "our," or "us"). These Terms & Conditions govern your use of our website and rental services. By accessing our website, requesting a reservation, or renting our equipment, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding agreement to rent equipment from Tidewater Totes.
2. Reservations
Reservations are subject to equipment availability and are not guaranteed until confirmed by Tidewater Totes.
We reserve the right to refuse or cancel any reservation due to equipment availability, incorrect pricing, suspected fraud, or other legitimate business reasons. Also, by submitting payment you agree to all terms and conditions set forth in this section.
3. Pricing
All prices are listed in U.S. Dollars.
Applicable Virginia sales tax will be added during checkout unless otherwise exempt by law.
Prices may change without prior notice; however, confirmed reservations will be honored at the agreed-upon rate.
4. Payments
Payment is due at the time of booking unless otherwise agreed in writing.
By submitting payment, you authorize Tidewater Totes to charge your selected payment method for:
Rental fees
Applicable taxes
Approved add-on services
Late fees
Cleaning fees
Replacement or damage charges as outlined in the Rental Agreement
5. Rental Equipment
Customers are responsible for all rented equipment from the time of delivery until pickup has been completed.
Equipment includes, but is not limited to:
Moving totes
Tote lids
Dollies
Hand trucks
Any additional rented accessories
6. Customer Responsibilities
Customers agree to:
Use equipment in a safe manner.
Keep equipment reasonably clean.
Protect equipment from theft, loss, or unnecessary damage.
Have all equipment empty and accessible at the scheduled pickup time.
Notify Tidewater Totes promptly if equipment is lost, damaged, or stolen.
7. Deliveries & Pickups
Customers are responsible for providing accurate delivery and pickup addresses.
Tidewater Totes is not responsible for delays caused by:
Severe weather
Traffic conditions
Road closures
Circumstances beyond our reasonable control
Reasonable efforts will be made to communicate any scheduling delays.
8. Cancellations
Reservations may be canceled without charge if canceled at least 24 hours before the scheduled delivery date.
Cancellations made within 24 hours of delivery may be subject to a cancellation fee.
9. Late Returns
Additional rental charges may apply if equipment is not available for pickup on the scheduled return date.
Continued failure to return equipment may result in replacement charges and collection efforts as permitted by law.
10. Damage or Loss
Customers are financially responsible for equipment that is lost, stolen, destroyed, or damaged beyond normal wear and tear.
Replacement costs are identified in the Rental Agreement and may be charged to the payment method on file.
Normal cosmetic wear from ordinary use is not considered damage.

Users agree not to:

12. Intellectual Property

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia.
Any legal action arising under these Terms shall be brought in a court of competent jurisdiction located within the Commonwealth of Virginia.
17. Changes to These Terms
Tidewater Totes may modify these Terms & Conditions at any time. Updated versions will be posted on this website with a revised Effective Date.
Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

Rental Agreement
TIDEWATER TOTES
RENTAL AGREEMENT
Effective Date: August 2026
This Rental Agreement ("Agreement") is entered into between Tidewater Totes ("Company," "we," "our," or "us") and the customer renting equipment ("Customer," "you," or "your").
By placing an order, signing this Agreement, or accepting delivery of rental equipment, you agree to the terms and conditions below.
1. RENTAL PACKAGES
Creek Package – $99 + applicable sales tax
Includes:
20 reusable moving totes
1 tote dolly
Two-week rental
Cove Package – $169 + applicable sales tax
Includes:
40 reusable moving totes
2 tote dollies
Two-week rental
Bay Package – $229 + applicable sales tax
Includes:
60 reusable moving totes
3 tote dollies
Two-week rental
Package contents are subject to availability.
2. OPTIONAL ADD-ONS
Additional equipment may be rented at the following rates:
Additional Tote: $3.00 each
Additional Tote Dolly: $20.00 each
All add-on equipment is subject to the same responsibilities and terms as the equipment included in your rental package.
3. RENTAL PERIOD
Your rental begins upon delivery of the equipment and ends when Tidewater Totes retrieves the equipment on the scheduled pickup date.
Standard rental packages include two (2) weeks.
If you need additional time, please contact us before your scheduled pickup date.
4. RENTAL EXTENSIONS
Rental extensions are subject to equipment availability.
Approved extensions will be charged at:
$20.00 per tote for each additional week.
Extension charges will be billed to the payment method on file.
If equipment is not available for pickup because it is inaccessible or not ready, additional rental charges may also apply.
5. DELIVERY & PICKUP
The Customer agrees to:
Provide accurate delivery and pickup addresses.
Ensure equipment is accessible at the scheduled pickup time.
Secure pets prior to delivery or pickup.
Provide safe access to the property.
If our driver is unable to complete delivery or pickup due to inaccessible equipment or unsafe conditions, additional service charges may apply.
6. CUSTOMER RESPONSIBILITIES
During the rental period, the Customer is responsible for all rented equipment.
Equipment should only be used for normal moving and storage purposes.
The Customer agrees not to:
Burn or melt equipment.
Store hazardous materials.
Modify equipment.
Leave equipment unattended in public areas.
Use equipment in a manner likely to cause damage.
7. DAMAGE, LOSS & REPLACEMENT
The Customer is responsible for all equipment until it has been picked up by Tidewater Totes.
Replacement charges are:

Normal cosmetic wear from ordinary residential moving—including light scratches and scuffs—will not be charged.
Charges may apply for:
Cracked or broken totes
Melted plastic
Excessive staining
Missing equipment
Chemical damage
Intentional damage
8. CLEANING FEE
Equipment must be returned in reasonably clean condition.
A $5.00 cleaning fee per tote may be assessed if equipment requires excessive cleaning due to:
Mud
Paint
Concrete
Animal waste
Food residue
Mold
Chemicals
Strong odors
Normal dust and minor dirt are considered ordinary wear.
9. INSPECTION
All equipment is inspected before delivery and after pickup.
The Company may photograph equipment before delivery and after pickup to document its condition.
Damage or shortages discovered during inspection may result in additional charges.
10. PAYMENT AUTHORIZATION
By renting from Tidewater Totes LLC, you authorize us to charge the payment method on file for:
Rental charges
Applicable Virginia sales tax
Approved extensions
Cleaning fees
Replacement costs
Damage charges
Late fees
Collection costs authorized by this Agreement
11. CANCELLATION POLICY
Orders canceled more than 24 hours before the scheduled delivery will receive a full refund.
Orders canceled within 24 hours of delivery may be subject to cancellation charges.
Once equipment has been delivered, rental charges are non-refundable.
12. LIMITATION OF LIABILITY
Tidewater Totes shall not be responsible for:
Damage to packed items
Delayed moves
Weather-related delays
Lost profits
Indirect or consequential damages
Personal injury resulting from misuse of rented equipment
Customers assume responsibility for the safe use of all rented equipment.
13. INDEMNIFICATION
The Customer agrees to defend, indemnify, and hold harmless Tidewater Totes, its owners, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from the Customer's use, misuse, possession, or storage of the rental equipment.
14. COLLECTION COSTS
If payment becomes delinquent, the Customer agrees to pay all reasonable costs of collection, including court costs, collection agency fees, reasonable attorney's fees, and any interest permitted under Virginia law.
15. GOVERNING LAW
This Agreement shall be governed by the laws of the Commonwealth of Virginia.
Any legal dispute arising under this Agreement shall be brought in a court of competent jurisdiction in Virginia.16. FORCE MAJEURE
Tidewater Totes shall not be liable for delays caused by circumstances beyond its reasonable control, including severe weather, flooding, traffic accidents, mechanical failures, labor disruptions, or governmental actions.
17. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between Tidewater Totes and the Customer.
No oral statements or representations modify this Agreement unless made in writing and signed by both parties.
CUSTOMER ACKNOWLEDGMENT
By submitting electronic payment, you are acknowledging you under the terms and conditions of rental from Tidewater Totes as Seth forth on this page.
